Haier Data Act Notice

Effective Date: 25 March 2026

Haier Air Conditioning & Heating – UK & IRE (“Haier”), is committed to ensuring that any data generated by our connected products and related services is used fairly, lawfully, and securely. We prioritize compliance with Regulation (EU) 2023/2854 (the “EU Data Act”). 

This Notice informs you as a user (“User”) about the types of data generated by Haier products and related services. Where Haier is the data holder under the EU Data Act, this Notice explains how such data is used, Users’ rights and obligations, how Users can access their data, and where to direct complaints. 

This Notice also provides the information required under Article 3(2) and (3) of the EU Data Act prior to the conclusion of a contract for connected products or the provision of related services. 

This Notice should be read together with Haier’s Privacy Policy, which takes precedence regarding personal data. 

1. Definitions and Scope

Products shall mean connected Haier appliances and devices (e.g., smart air conditioners, refrigerators, washing machines) that generate data accessible to the User or Haier. 

Related Services shall mean applications or cloud services provided by Haier that collect, process or store data from the Products, including Haier Smart Home App and Haier Service Cloud. 

Data shall mean product data and related service data that are generated, collected, stored, or otherwise made available in connection with the use of the Products and Related Services. Data does not include derived, inferred or proprietary data resulting from Haier’s internal analytics, algorithms, or business processes, except where disclosure is required under applicable law. 

2. Data Collected and Its Format

The Data covered by this Notice includes any readily available data generated by Products or Related Services, as described in Haier’s Product Data specification (available separately). This may include: 

  • Device operational parameters 
  • Usage history and settings 
  • Sensor values and status reports 

Data will be made available in a comprehensive, structured, commonly used and machinereadable format, and with a level of quality at least equivalent to how it becomes available to Haier. 

3. Pre‑Contractual Information

Before entering into a contract for a Product or a Related Service, User is informed that: 

  1. Products and Related Services generate Data as a result of their use; 
  2. Where technically feasible, User may directly access Data through the Product or Related Service interface; 
  3. Where direct access is not available, User may request access to Data from Haier; 
  4. User has the right to request that Data be made available to a third‑party recipient of his/her/its choice; 
  5. Haier may use non‑personal Data generated by the use of the Products and Related Services for the purposes described in this Notice; 
  6. Data retention periods are described in applicable Product documentation or Related Services terms; 
  7. Processing of personal data is governed by Haier’s Privacy Policy. 

3. Use of Data by Haier

Haier uses Data, including non-personal data, only for purposes necessary to: 

  1. Provide and improve services and Products. 
  2. Fulfill contractual obligations, including billing, reporting, and analysis. 
  3. Offer support, warranty, or guarantee services, and assess user or third-party claims. 
  4. Monitor, maintain, and ensure the safety, security, and proper functioning of Products and related services. 
  5. Develop new or enhanced products or services, including advanced analytics or AI features. 

Haier will not use Data in a way that would undermine your legitimate interests or insights into your commercial position. 

Where required under the EU Data Act, Haier’s continued use of non‑personal Data generated by the User’s use of Products or Related Services is subject to the User’s rights under Article 4 of the EU Data Act. 

4. Data Sharing

Haier may share Data with: 

  • Haier affiliates and subsidiaries for internal operations. 
  • Service providers supporting the purposes above, under contractual obligations to act only on Haier’s instructions. 
  • Legal authorities when required by law or to protect rights, safety or security. 
  • Third parties in connection with corporate transactions (e.g., mergers), subject to applicable legal requirements. 

Haier will not share nonpersonal Product or Service Data with third parties outside these purposes unless agreed with the User. 

Where a User requests that Data be made available to a third party under Article 5 of the EU Data Act, Haier will make such Data available in accordance with Articles 5, 8 and 9 of the EU Data Act. 

5. User Rights and Data Access

To the extent supported by product design, Users may access Data directly through the Product or Related Service interfaces.  

Upon request, Haier will make Data available to the User or a thirdparty recipient designated by the User. Requests should be sent to [email protected]. Verification of identity or authorization may be required. 

Data will be provided securely, using commonly accepted secure transport methods. 

Haier will supply Data in a structured, common and machinereadable format. This follows the EU Data Act requirement that data be accessible and usable without discrimination. 

Users and third‑party recipients shall comply with applicable EU law and contractual terms when using, processing or sharing Data, including obligations to preserve confidentiality and trade secrets where applicable.  

6. Conditions, Security and Trade Secrets

Access to or sharing of Data may be limited or refused only where strictly necessary to: 

  • Protect the security requirements of a Product or Related Service; or 
  • Prevent a serious adverse effect on the health, safety, or security of natural persons. 

Where Data includes trade secrets, Haier may require the User or third‑party recipient to implement appropriate technical and organizational measures to preserve confidentiality. 

If, despite such measures, disclosure would be likely to cause serious economic damage to Haier, Haier may refuse access in accordance with the EU Data Act and notify the competent authority where required. 

7. Data Sharing with Third Parties and Compensation

Data made available to Users under the EU Data Act is provided free of charge. 

Where Data is made available to a thirdparty recipient at the User’s request, Haier may request reasonable compensation, limited to the direct costs incurred in making the Data available. Any such compensation will be transparent, nondiscriminatory, and proportionate.

Without prejudice to the right to seek judicial redress, Users may: 

  • Lodge a complaint with the competent authority designated under Article 37 of the EU Data Act; or 

Where agreed, submit disputes to a certified dispute settlement body in accordance with Article 10 of the EU Data Act.
